1. Acceptance of the terms
By using the Mrafad website, its apps or its admin console, you acknowledge that you have read, understood and accepted these terms, and that you are legally authorised to act on behalf of your company. If you do not agree, do not use the platform.
2. Definitions
"The platform": the Mrafad website, its two apps and its admin console. "The requesting company": the licensed party requesting a service. "The provider": the party delivering it. "Listing": a request or offer published in the market. "The contract": the agreement arising between the parties inside the platform. "Escrow": holding the contract amount with the platform until delivery is confirmed.
3. The nature of Mrafad's role
Mrafad is a technical intermediary that provides a place to meet and contract and a tool for escrow payment. It is not a party to the contract, not a seller of the service, and not an agent for either party.
The platform does not guarantee the quality of the service delivered nor the truth of what any party declares about itself; it does, however, verify licences as far as the competent authorities allow, and suspends whoever breaches the rules.
4. Eligibility, registration and verification
Registration is limited to licensed companies; no accounts are opened for individuals.
You undertake to provide accurate, up-to-date information, to keep your access credentials confidential, and to inform us immediately of any unauthorised use of your account.
No request may be sent, no offer submitted and no contract concluded before verification is complete and the account is approved.
5. Obligations of the requesting company
- Describing the request accurately and completely: quantities, dates, specifications and city.
- Responding to offers within their validity period, and not using the platform to collect prices with no intention of contracting.
- Paying the amount by the method agreed in the contract, and confirming delivery once it has taken place.
- Not demanding from the provider anything outside the contract, and not bypassing the platform to contract off it after an introduction made through it.
6. Obligations of the provider
- Holding valid licences for every field in which it advertises, and renewing them upon expiry.
- Accuracy of the prices, capacity and terms advertised, and not publishing photographs that do not belong to its own premises.
- Abiding by the offer it submitted once accepted, and delivering the service on time and to the agreed specifications.
- Uploading delivery proofs on schedule, and responding to messages and disputes within the set periods.
- Not requesting payment outside the platform in contracts where escrow payment was chosen.
7. Listings and prohibited content
You are responsible for what you publish. The following is prohibited; anything in breach is removed and the publisher's account suspended:
- Services you are not licensed to practise, or services that contravene Hajj and Umrah regulations.
- Fictitious prices, unavailable capacity, or photographs taken from a source other than your own.
- Contact details inside the listing text with the intent of bypassing the platform.
- Content contrary to law or public decency, or offensive to any person or entity.
We have zero tolerance for objectionable content and abusive users. This covers everything published or sent on the platform: requests, offers, reviews and replies, organisation profiles and photos, and the conversations between organisations. In particular, the following is prohibited:
- Insults, harassment, threats, discrimination and hate speech.
- Spam, repetitive messages and unsolicited advertising.
- Fraud, impersonating another organisation, and requesting payment by misleading means.
- Obscene, violent or otherwise inappropriate content.
Reporting and blocking: every user can report any message, conversation, organisation, request, offer, review or listing with «Report» in the app, and can block any organisation from the conversation menu with «Block organisation»; its messages then stop reaching them and it cannot start a new conversation with them. Blocking does not cancel existing obligations: contracts, escrow and disputes remain in force under these terms.
The MRAFAD team reviews every report within 24 hours of receiving it, removes content that breaches these terms, and suspends or terminates the offending organisation's account when the breach is confirmed, keeping a record of every action.
8. Requests, offers and contracts
A request is an invitation to contract, not a binding offer; a provider's offer is binding throughout its validity period, and the contract is concluded when the requesting company accepts the offer inside the platform.
The digital contract issued by the platform is the reference in case of disagreement, and is kept by both parties and by the platform.
Any amendment to the contract after signing requires both parties' acceptance inside the platform.
9. Prices, commission and invoices
The platform takes a commission on contracts concluded through it; its rate is published on the pricing page and deducted upon release of the amount.
Commission invoices are issued electronically in line with e-invoicing requirements, and value-added tax is added where applicable.
Service prices between the parties are their own affair, and the platform does not intervene in setting them.
10. Payment and escrow
Where both parties choose escrow payment, the amount is held by the platform and released to the provider only after delivery is confirmed, or after the objection period lapses without objection. The "Escrow & Refund Policy" sets this out in detail.
If the parties choose to pay outside the platform, the responsibility is theirs alone, and neither escrow nor the dispute resolution mechanism covers it.
11. Cancellation and refunds
Cancellation and refunds are governed by the "Escrow & Refund Policy" published on the platform, which forms an integral part of these terms.
12. Disputes
Either party may open a dispute within the objection period, attaching its evidence. The held amount is frozen until the platform's administration issues a written decision based on the contract and the evidence, and that decision is enforced against the held amount alone.
The platform's decision regarding the held amount does not prevent either party from resorting to the competent judicial authorities.
13. External listings and other platforms
The platform may display results from external platforms tagged with their source, and may allow you to publish your listing on them. Such listings are governed by those platforms' terms and are covered by neither Mrafad's guarantees nor its verification nor its dispute resolution; dealing with them is at both parties' own risk.
14. Intellectual property
The platform, its name, logo, designs and software are owned by Mrafad. Content you upload remains yours, and you grant the platform a non-exclusive licence to display it within the service and on the platforms you chose to publish to.
15. Suspension and termination of an account
The platform may suspend or terminate an account upon a breach of these terms, a suspicion of fraud, or a legal request. You may terminate your account whenever you wish, provided that active contracts and held amounts are settled first.
16. Limitation of liability
The platform is provided "as is", with no guarantee of being free from interruption or error. The platform bears no liability for indirect damages or loss of profit. In all cases, the platform's liability towards any party shall not exceed the commission it received on the contract in dispute.
17. Governing law and jurisdiction
These terms are governed by the laws of the Kingdom of Saudi Arabia, and the competent judicial authorities there have jurisdiction over any dispute arising from them.
18. Amendment of these terms
These terms may be updated, and the update is published on this page with its date. Your continued use of the platform after an update takes effect constitutes acceptance of it.
